Representationalism—the view that scientific modeling is best understood in representational terms—is the received view in contemporary philosophy of science. Contributions to this literature have focused on a number of puzzles concerning the nature of representation and the epistemic role of misrepresentation, without considering whether these puzzles are the product of an inadequate analytical framework. The goal of this paper is to suggest that this possibility should be taken seriously. The argument has two parts, employing the “can’t have” and “don’t need” (...) tactics drawn from philosophy of mind. On the one hand, I propose that representationalism doesn’t work: different ways to flesh out representationalism create a tension between its ontological and epistemological components and thereby undermine the view. On the other hand, I propose that representationalism is not needed in the first place—a position I articulate based on a pragmatic stance on the success of scientific research and on the feasibility of alternative philosophical frameworks. I conclude that representationalism is untenable and unnecessary, a philosophical dead end. A new way of thinking is called for if we are to make progress in our understanding of scientific modeling. Philosophy of science has undergone a naturalistic turn, moving away from traditional idealized concerns with the logical structure of scientific theories and toward focusing on real-world scientific practice, especially in domains such as modeling and experimentation. As part of this shift, recent work has explored how the project of philosophically understanding science as a natural phenomenon can be enriched by drawing from different fields and disciplines, including niche construction theory in evolutionary biology, on the one hand, and ecological and enactive (...) views in embodied cognitive science, on the other. But these insights have so far been explored in separation from each other, without clear indication of whether they can work together. Moreover, the focus on particular practices, however insightful, has tended to lack consideration of potential further implications for a naturalized understanding of science as a whole (i.e., above and beyond those particular practices). Motivated by these developments, here we sketch a broad-ranging view of science, scientific practice and scientific knowledge in terms of ecological-enactive co-construction. The view we propose situates science in the biological, evolutionary context of human embodied cognitive activity aimed at addressing the demands of life. This motivates reframing theory as practice, and reconceptualizing scientific knowledge in ecological terms, as relational and world-involving. Our view also brings to the forefront of attention the fundamental link between ideas about the nature of mind, of science and of nature itself, which we explore by outlining how our proposal differs from more conservative, and narrower, conceptions of “cognitive niche construction.”. A persistent criticism of radical embodied cognitive science is that it will be impossible to explain “real cognition” without invoking mental representations. This paper provides an account of explicit, real-time thinking of the kind we engage in when we imagine counter-factual situations, remember the past, and plan for the future. We first present a very general non-representational account of explicit thinking, based on pragmatist philosophy of science. A powerful idea put forward in the recent philosophy of science literature is that scientific models are best understood as instruments, tools or, more generally, artifacts. This idea has thus far been developed in combination with the more traditional representational approach: accordingly, current artifactualist accounts treat models as representational tools. But artifactualism and representationalism are independent views, and adopting one does not require acceptance of the other. This paper argues that a leaner version of artifactualism, free of representationalist assumptions, is (...) both desirable and viable. One persistent question in jurisprudence relates to the role of morality in the concept of law. For instance, consider the question of whether unjust statutes are laws. Legal positivists say that they’re laws in every relevant sense, while natural lawyers say that they’re not. This article considers a different answer inspired by recent findings in experimental philosophy: there is one relevant sense in which unjust statutes are laws, but also a different relevant sense in which they aren’t. After considering the (...) ways in which this alternative differs from some of the mainstream theories in general jurisprudence, the article argues that it provides more elegant solutions to two problems that have puzzled legal philosophers in the past: the paradox of customary international law and the shifts in legal discourse over history. Debate about cognitive science explanations has been formulated in terms of identifying the proper level(s) of explanation. Views range from reductionist, favoring only neuroscience explanations, to mechanist, favoring the integration of multiple levels, to pluralist, favoring the preservation of even the most general, high-level explanations, such as those provided by embodied or dynamical approaches. In this paper, we challenge this framing. We suggest that these are not different levels of explanation at all but, rather, different styles of explanation that capture (...) different, cross-cutting patterns in cognitive phenomena. Which pattern is explanatory depends on both the cognitive phenomenon under investigation and the research interests occasioning the explanation. This reframing changes how we should answer the basic questions of which cognitive science approaches explain and how these explanations relate to one another. On this view, we should expect different approaches to offer independent explanations in terms of their different focal patterns and the value of those explanations to partly derive from the broad patterns they feature. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

The question whether cognition ever extends beyond the head is widely considered to be an empirical issue. And yet, all the evidence amassed in recent years has not sufficed to settle the debate. In this paper we suggest that this is because the debate is not really an empirical one, but rather a matter of definition. Traditional cognitive science can be identified as wedded to the ideals of “smallism” and “localism”. We criticize these ideals and articulate a case in favor (...) of extended cognition by highlighting the historical pedigree and conceptual adequacy of related empirical and theoretical work. Psychology has a WEIRD problem. It is overly reliant on participants from Western, Educated, Industrialized, Rich, and Democratic societies. Over the last decade this problem has come to be widely acknowledged, yet there has been little progress toward making psychology more diverse. This Element proposes that the lack of progress can be explained by the fact that the original WEIRD critique was too narrow in scope. Rather than a single problem of a lack of diversity among research participants, there are (...) at least four overlapping problems. Psychology is WEIRD not only in terms of who makes up its participant pool, but also in terms of its theoretical commitments, methodological assumptions, and institutional structures. Psychology as currently constituted is a fundamentally WEIRD enterprise. Coming to terms with this is necessary if we wish to make psychology relevant for all humanity. (shrink)

O artigo apresenta a defesa da racionalidade da crença em Deus desenvolvida pelo filósofo reformado Alvin Plantinga, a partir de sua redefinição como “crença apropriadamente básica”. Após uma breve introdução, que situa a epistemologia religiosa de Plantinga no contexto das transformações recentes no campo da filosofia analítica da religião, expõe-se a crítica de Plantinga ao fundacionalismo clássico, cujo colapso teria reaberto a viabilidade epistemológica da crença em Deus. Segue-se a defesa plantingiana da crença em Deus como crença apropriadamente básica, que (...) teria bases experienciais identificáveis, mas dispensaria qualquer evidência ou demonstração racional, mostrando a orientação firme da construção plantingiana em direção a uma forma plenamente externalista de epistemologia. O final do artigo oferece uma breve reflexão sobre o significado cultural e espiritual da epistemologia reformada de Plantinga. ABSTRACT The article presents a defense of the rationality of the belief in God, developed by reformed philosopher Alvin Plantinga, who redefined it as a “properly basic belief”. After a brief introduction to place Plantinga’s religious epistemology in the context of recent transformations in the field of analytical philosophy of religion, Plantinga’s critique to classic foundationalism, whose collapse opened the epistemological viability of belief in God, is exposed. Then, the article focuses on the Plantingian defense of belief in God as a properly basic belief, nased on identifiable experiential grounds but independent from all evidence or rational demonstration, thus showing the firm orientation of Plantinga’s construction towards a fully externalist form of epistemology. The conclusion offers a short reflection on the cultural and spiritual meaning of Plantinga’s reformed epistemology. Investigar a substância epistemológica da psicanálise pressupõe o atravessamento de um conjunto de autores que navegam por essas marés, e que nos convidam a nós leitores a desbravar os mares agitados e taciturnos da jornada psicanalítica. A aventura sobre a qual o leitor é convidado a atravessar em psicanálise certamente é bordeada por um percurso incerto, arriscado, e naturalmente angustiante. No entanto, vez ou outra, as circunstâncias do Real fazem emergir alguns personagens que tornam essa jornada mais fluida e encorajadora, (...) oferecendo-nos alguns resíduos conceituais e operacionais que nos despertam interesse e curiosidade, servindo como um guia de viagem, ou seja, há livros que caem em nossas mãos como um mapa, e assim como todo mapa em uma aventura fictícia: nos conduz a um valioso tesouro. O mapa sobre a qual o leitor possui a possibilidade de se aventurar, se trata do livro publicado em 2018 pela editora Blucher, “A Bruxa Metapsicologia e seus Destinos”, organizado por um dos grandes nomes da Filosofia da Psicanálise no Brasil, Leopoldo Fulgencio, além de outros nomes caricaturais, como Richard Simanke, Antonio Imasciati e Martine Girard. O livro é resultado de inúmeras pesquisas que vêm sendo realizadas há mais de décadas pelos autores, direcionando-nos às indagações não somente em um caráter histórico e epistemológico da psicanálise, mas despertando possibilidades de reconfigurações epistemológicas, dando novos formatos de existência às novas práticas científicas do século XXI. O valioso tesouro sobre o qual o mapa conduz a nós leitores, refere-se não somente à leve e agradável compreensão em relação a epistemologia da psicanálise e seus elementos associados, assim como as propostas apresentadas pelos autores em nos guiar imperceptivelmente ao núcleo da filosofia da psicanálise, endereçando-nos como que espontaneamente em um percurso conceitual que atravessa a natureza da metapsicologia, a sua função no panorama do desenvolvimento da psicanálise e suas repercussões epistemológicas dentro do cenário da filosofia da psicanálise. Além de navegarem conceitual e historicamente pela natureza da metapsicologia dentro da atmosfera intelectual do início do século XX, também apontam elementos que nos fazem pensar sobre qual é o destino da metapsicologia a partir do século XXI, considerando novas formatações epistemológicas e filosóficas. Como sabemos que é impossível abarcar a experiência em sua totalidade, me arrisco aqui em exprimir em palavras um recorte parcial dessa experiência, buscando expressar em forma de uma resenha quais foram as impressões teóricas, epistemológicas e filosóficas designadas ao leitor que se propõe a ler o livro “A Bruxa Metapsicologia e seus Destinos”. Destaco, sobretudo, que a metáfora utilizada sobre o livro como um mapa e seu conteúdo como um tesouro, não possui qualidade unicamente estilística, mas sobretudo, conceitual, uma vez que a metáfora e a ficção possuem um valor epistemológico constituinte dentro da metapsicologia, conforme será explorado adiante. An intuitive view is that creativity involves bringing together what is already known and familiar in a way that produces something new. In cognitive science, this intuition is typically formalized in terms of computational processes that combine or associate internally represented information. From this computationalist perspective, it is hard to imagine how non-representational approaches in embodied cognitive science could shed light on creativity, especially when it comes to abstract conceptual reasoning of the kind scientists so often engage in. The present (...) article offers an entry point to addressing this challenge. The scientific project of embodied cognitive science is a continuation of work in the functionalist tradition in psychology developed over a century ago by William James and John Dewey, among others. The focus here is on how functionalist views on the nature of mind, thought, and experience offer an alternative starting point for cognitive science in general, and for the cognitive science of scientific creativity in particular. The result may seem paradoxical. On the one hand, the article claims that the functionalist conceptual framework motivates rejecting mainstream cognitive views of creativity as the combination or association of ideas. On the other hand, however, the strategy adopted here—namely, revisiting ideas from functionalist psychology to inform current scientific theorizing—can itself be described as a process of arriving at new, creative ideas from combinations of old ones. As is shown here, a proper understanding of cognition in light of the functionalist tradition resolves the seeming tension between these two claims. (shrink)

A popular trend in the sciences of the mind is to understand cognition as embodied, embedded, enactive, ecological, and so on. While some of the work under the label of “embodied cognition” takes for granted key commitments of traditional cognitive science, other projects coincide in treating embodiment as the starting point for an entirely different way of investigating all of cognition. Focusing on the latter, this paper discusses how embodied cognitive science can be made more reflexive and more sensitive to (...) the implications that our views of cognition have for how we understand scientific practice, including our own theorizing about cognition. Inspired by the “strong programme” in the sociology of scientific knowledge, I explore the prospect of an analogously “strong” program in embodied cognitive science. I first draw from Dewey’s transactional notion of “situation” to identify a broad sense in which embodied cognitive science takes cognition, as an embodied phenomenon, to be _situated_. I then sketch a perspective I call _situated reflexivity_, which extends the Deweyan analysis to understand scientific practice in the same terms, and thereby illustrates what research in line with a strong program in embodied cognitive science can look like. This move, I propose, has the potential of setting up a new inquiry situation that makes more salient the embodiment of scientific practice and that, through this, can help organize our own embodied cognitive activities as we try to make sense of scientific work, including our own. Disagreement on law’s relationship to morality has long been driven by disagreement about our ordinary concept. Until recently, however, there had been no systematic investigation of lay intuitions. In this paper, we advance this nascent effort. Across two studies (N = 697), our findings reveal that most people consider law to be more than a matter of political circumstance alone. Contrary to the expectations of most contemporary philosophers, morality (both substantive and procedural) emerges as a key influence on judgments of (...) legal validity: many people say that conduct prohibited by immoral statutes is not truly illegal, and that immoral conduct which was never explicitly prohibited is truly illegal. This suggests that people often treat law as a dual character concept that, like the concepts of scientist or of artist, features autonomous concrete and abstract dimensions. (shrink)

For decades now a research question has firmly established itself as a staple of psychological and neuroscientific investigations on language, namely the question of whether and how bilingualism is cognitively beneficial, detrimental or neutral. As more and more studies appear every year, it seems as though the research question itself is firmly grounded and can be answered if only we use the right experimental manipulations and subject the data to the right analysis methods and interpretive lens. In this paper we (...) propose that, rather than merely improving prior methods in the pursuit of evidence in one direction or another, we would do well to carefully consider whether the research question itself is as firmly grounded as it might appear to be. We identify two bodies of research that suggest the research question to be highly problematic. In particular, drawing from work in sociolinguistics and in embodied cognitive science, we argue that the research question of whether bilingualism is cognitively advantageous or not is based on problematic assumptions about language and cognition. Once these assumptions are addressed head on, a straightforward answer to the question arises, but the question itself comes to seem to be a poor starting point for research. After examining why this is so, we conclude by exploring some implications for future research. (shrink)

Explanatory diversity is a salient feature of the sciences of the mind, where different projects focus on neural, psychological, cognitive, social or other explanations. The same happens within embodied cognitive science, where ecological, enactive, dynamical, phenomenological and other approaches differ from each other in their explanations of the embodied mind. As traditionally conceived, explanatory diversity is philosophically problematic, fueling debates about whether the different explanations are competing, compatible, or tangential. In contrast, this paper takes the perspective of embodied cognitive science (...) as its starting point and accordingly approaches explanatory diversity not as a problem to be solved, but as a phenomenon to be understood. Recent work has explored how the view of cognition as embodied motivates reflexively viewing science as a situated embodied cognitive practice. Here I argue that this reflexive turn motivates adopting a pluralistic stance when it comes to questions about theoretical and methodological disagreements. In particular, it motivates moving away from thinking in terms of explanations as disembodied entities that compete with one another, and instead thinking in terms of different explanatory styles as embodied practices of explaining, many of which might be legitimate and warranted independently of whether and how the explanations themselves relate to one another. Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals. On the face of it, the perspective that Casper puts forward in his paper (Chap. 2) and the one I offer in mine (Chap. 4)are completely at odds with each other. He sees the current diversity of explanations, theories and methods in embodied cognitive science as problematic and calling for some kind of integration, whereas I defend an extreme pluralist stance and don’t see the diversity as a problem. Not only that, but while he argues for coordination between the disparate (...) approaches, I propose that expecting such coordination is in many cases unrealistic and moreover that, even when it’s possible, it might be counterproductive. The straightforward thing to do now would be for me to double down and use this space to try to show why I’m right and Casper is wrong. But I don’t think he’s wrong. He and I do disagree, but I don’t think it’s that sort of disagreement where only one side can be right and the other must be wrong. In particular, I don’t think that focusing on the different conclusions he and I draw in our respective chapters is a fruitful way to understand the nature of our disagreement. My goal in this commentary will be to explain why. I don’t know if Casper will agree with my assessment or not, but I won’t be surprised if he doesn’t—in fact, as I will suggest, this would make perfect sense given what I propose in my chapter. Still, my hope is that, by clarifying how (from my perspective) our different views relate to each other, I can help some readers better appreciate both his proposal and mine. (shrink)

Are the theoretical frameworks of phenomenology and of science compatible? And, if so, what would a reconciliation entail for science as it is practiced? Gallagher [2019] poses these two questions, answering the first in the affirmative and leaving the second unaddressed. I argue that treating the two as separate questions presupposes an inadequate distinction between theory and practice that Gallagher’s non-reductive framework motivates rejecting. Recognizing the intertwining of theory and practice allows us to answer Gallagher’s two questions about phenomenology and (...) science all at once, but it also motivates a less conciliatory conclusion than the one he offers. The more we rely on digital assistants, online search engines, and AI systems to revise our system of beliefs and increase our body of knowledge, the less we are able to resort to some independent criterion, unrelated to further digital tools, in order to asses the epistemic reliability of the outputs delivered by them. This raises some important questions to epistemology in general and pressing questions to applied to epistemology in particular. In this paper, we propose an experimental method for (...) the assessment of GPT-3’s capacity to generate consistent and coherent sets of outputs. When several outputs to one and the same input are very repetitive they tend to be consistent with each other, that is they do not contradict each other. But consistency does not make the set of outputs as a whole more informative than the outputs considered individually. We argue that the less informative a set of outputs is, the less coherent it is. We establish a conceptual distinction between consistency and coherence in the light of what some epistemologists refer to as a coherence theories of truth and justification. While much attention has been given to GPT-3’s capacity to produce internally coherent individual outputs, we argue, instead, that more attention should be given to its capacity to produce consistent and coherent outputs generated on a single-input-multiple-outputs basis. É comumente aceito, atualmente, que Aristóteles não teria enfrentado ou tentado seriamente resolver o famoso paradoxo do mentiroso, embora ele tenha sido formulado por Eubúlides de Mileto, membro da escola megárica e rival filosófico de Aristóteles. No máximo, assim reza a visão tradicional, ele parece apenas fazer uma menção desse paradoxo nas Refutações sofísticas, Capítulo 25, talvez esboçando a sua solução. O meu intento, no presente artigo, é desafiar essa opinião geral mostrando que o Estagirita fornece uma explicação implícita para (...) duas versões do paradoxo do mentiroso, a saber, a versão autorreferencial, e a versão anafórica. A minha alegação é que a solução aristotélica para essas duas versões do paradoxo encontra-se no núcleo de sua refutação de duas teses, as quais denominei como tese da synalethia e como tese da sympseudia. Tal refutação é realizada no oitavo capítulo do quarto Livro da Metafísica, um texto até agora subestimado pelos intérpretes modernos, mesmo sendo a parte final de um dos mais importantes escritos de Aristóteles. A solução aristotélica, assim defendo, é levada a cabo por meio dos seguintes princípios: toda declaração é sempre precedida por um operador de verdade da forma ‘é verdade que...’, ou seja, toda declaração, qualquer que seja o que ela possa declarar a mais, primariamente assevera a sua própria verdade; e, em conformidade com o princípio anterior, toda declaração que assevera a sua própria falsidade ou acarreta a verdade de sua contraditória é necessariamente falsa. Através desses princípios, a refutação de Aristóteles da synalethia e da sympseudia é bem-sucedida. Mostrarei que obtemos uma boa solução para as versões do mentiroso acima mencionadas, apenas aplicando esses mesmos princípios a elas. Esse tipo de solução ao mentiroso tanto quanto para as teses antes citadas é muito parecido com aquele explicitamente encontrado nas obras de diversos filósofos, a saber, Guilherme de Sherwood, Tomás Bradwardine, João Buridano, Alberto da Saxônia, Paulo Venetus, Charles S. Peirce e Arthur Prior. Assim, também defendo que essa linhagem tem as suas raízes na solução de Aristóteles. (shrink)

In abstract algebraic logic, many systems, such as those paraconsistent logics taking inspiration from da Costa's hierarchy, are not algebraizable by even the broadest standard methodologies, as that of Blok and Pigozzi. However, these logics can be semantically characterized by means of non-deterministic algebraic structures such as Nmatrices, RNmatrices and swap structures. These structures are based on multialgebras, which generalize algebras by allowing the result of an operation to assume a non-empty set of values. This leads to an interest in (...) exploring the foundations of multialgebras applied to the study of logic systems. It is well known from universal algebra that, for every signature \, there exist algebras over \ which are absolutely free, meaning that they do not satisfy any identities or, alternatively, satisfy the universal mapping property for the class of \-algebras. Furthermore, once we fix a cardinality of the generating set, they are, up to isomorphisms, unique, and equal to algebras of terms. Equivalently, the forgetful functor, from the category of \-algebras to Set, has a left adjoint. This result does not extend to multialgebras. Not only multialgebras satisfying the universal mapping property do not exist, but the forgetful functor \, from the category of \-multialgebras to Set, does not have a left adjoint. In this paper we generalize, in a natural way, algebras of terms to multialgebras of terms, whose family of submultialgebras enjoys many properties of the former. One example is that, to every pair consisting of a function, from a submultialgebra of a multialgebra of terms to another multialgebra, and a collection of choices, there corresponds a unique homomorphism, what resembles the universal mapping property. Another example is that the multialgebras of terms are generated by a set that may be viewed as a strong basis, which we call the ground of the multialgebra. Submultialgebras of multialgebras of terms are what we call weakly free multialgebras. Finally, with these definitions at hand, we offer a simple proof that multialgebras with the universal mapping property for the class of all multialgebras do not exist and that \ does not have a left adjoint. Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

A cross-cultural survey experiment revealed a dominant tendency to rely on a rule’s letter over its spirit when deciding which behaviors violate the rule. This tendency varied markedly across (k = 15) countries, owing to variation in the impact of moral appraisals on judgments of rule violation. Compared with laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether and consequently exhibited stronger textualist tendencies. Finally, we evaluated a plausible mechanism for the emergence of textualism: (...) in a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (total n = 5,794) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers, and judges. Esta pesquisa teve por objetivo investigar e propor um modelo matemático de otimização voltado para a identificação de cardápios formados por refeições diárias capazes de atender aos parâmetros nutricionais estabelecidos por profissionais de nutrição, identificando composições saudáveis entre pratos principais e acompanhamentos, gastronomicamente harmonizados e diversificados, e ainda, ao menor custo possível (custo mínimo). Com base em um problema de programação linear binário, no qual assumiu-se o valor 1 (um) para as combinações de receitas de pratos (principal e acompanhamento) a (...) serem utilizados na composição das refeições de dietas nutricionalmente parametrizadas e, consequentemente, na formação do cardápio mensal, ou valor 0 (zero) em caso contrário, a aplicação computacional do modelo proposto, baseada em dados reais, resultou na composição de uma dieta formada por combinações de receitas de pratos saudáveis, segundo os parâmetros nutricionais e gastronômicos estabelecidos, e ainda, que permitissem diversificar o respectivo cardápio e apurar o menor custo total possível para a referida dieta. Recent literature in experimental philosophy has postulated the existence of the abstract/concrete paradox : the tendency to activate inconsistent intuitions depending on whether a problem to be analyzed is framed in abstract terms or is described as a concrete case. One recent study supports the thesis that this effect influences judicial decision-making, including decision-making by professional judges, in areas such as interpretation of constitutional principles and application of clear-cut rules. Here, following the existing literature in legal theory, we argue that (...) the susceptibility to such an effect might depend on whether decision-makers operate in a legal system characterized by the formalist or particularist approach to legal interpretation, with formalist systems being less susceptible to the effect. To test this hypothesis, we compare the results of experimental studies on ACP run on samples from two countries differing in legal culture: Poland and Brazil. The lack of significant differences between those results suggests that ACP is a robust effect in the legal context. (shrink)

This paper presents an ontological perspective that enables evaluating the effectiveness of business models from an integrative worldview. Different groups’ fragmented and reductionist views on this topic create a dichotomy that makes it difficult to compare and analyze them in practice. Such groups use different values for some components, which may result in neglecting others and their interrelationship. This study discusses a functional characteristic of business models that academia still needs to address. It explores new frontiers in the field, such (...) as business models for networks, sustainability, and their practical evaluation. To achieve an integrative ontology and avoid focusing on specific constructs or systems at the expense of others, we draw upon the theory of worldviews from Wilhelm Dilthey, reformational philosophy, and Herman Dooyeweerd’s theory of modal aspects. Society should move beyond dualistic thinking and embrace practical and applicable solutions. To help companies develop effective models, we introduce a new business model framework based on an integrative worldview that enables comparisons and evaluations of companies in practice. Creating competitive advantages and value appropriations synergizes with essential aspects of reformational philosophy. Analyzing and interrelating such elements are fundamental to understanding the real applied value of business models. (shrink)

Este artigo aborda a mudança de paradigma para a noção de trabalho na sociedade impactada pela transformação digital. Reformulando o conceito de trabalho como transformação conservadora de energia, de acordo com a primeira lei da termodinâmica, para o entendimento do trabalho como redução da entropia, conforme a segunda lei, é possível compatibilizá-lo com os conceitos de informação e de comunicação. O artigo sugere que esta reformulação já estava implícita na teoria marxista e a diferencia do modelo ricardiano clássico. A transformação (...) digital é pensada como corte epistemológico no modo de produção, que traz consequências para o sistema funcional da economia. Neste, o modo dominante da economia capitalista (o capitalismo de plataforma) é confrontado com modos alternativos como o da Economia Solidária. O artigo examina se a transformação digital traz vantagens comparativas para a Economia Solidária e conclui positivamente neste sentido. (shrink)

Este artigo teórico consiste na avaliação da investigação jornalística de Daniela Arbex acerca do funcionamento do Hospital Colônia em Barbacena, Minas Gerais, a partir da análise biopolítica do pensador Michel Foucault. O processo de internamento dessa instituição representa, a partir das pesquisas foucaultianas acerca do trato da loucura na Europa moderna, um sólido exemplo do funcionamento da biopolítica no Brasil, mais especificamente no que tange ao fundamento de seu “fazer viver e deixar morrer”. Comparamos o projeto de cuidado terapêutico próprio (...) do saber médico com os procedimentos utilizados nesse ambiente de internação no Brasil do século XX. Desse modo, abordamos o desdobramento para racismo de Estado quando o Colônia assume a função não mais de “deixar morrer”, mas de “fazer morrer” dentro das técnicas do biopoder. Por fim, consideramos o papel da luta antimanicomial organizada no Brasil na década de 1990 enquanto alternativa à internação, mas que acaba promovendo, por sua vez, normalizações outras. (shrink)

No artigo O mito da atitude estética, dentre outros trabalhos, o filósofo George Dickie se opõe a teses que circunscrevem a apreciação das obras de arte a determinados estados psicológicos centrados na noção de desinteresse prático e que fundamentariam o único espaço onde elas teriam significado enquanto tais. Nosso propósito aqui, num primeiro momento, será explicitar um dos aspectos pontuais desta crítica, qual seja, a análise e objeção ao conceito de “atitude estética” defendido por Jerome Stolnitz. Num segundo momento, questionaremos (...) se, de modo geral, a objeção àquele conceito pode ser estendida ao valor da estética, considerada irrelevante para a teoria institucional da arte, o centro da filosofia de Dickie. Nesta direção, retomaremos a antiga discussão sobre a demarcação de fronteiras entre estética e filosofia da arte, mas o faremos a partir da perspectiva de Dickie e, longe de esgotá-la, apenas indicaremos possíveis caminhos para a relação entre estas duas instâncias. A obra O direito dos povos fecha a trilogia de reflexões de Rawls sobre a justiça, sustentando que povos razoáveis podem conviver de maneira pacífica em um mundo justo. Seu objetivo fundamental é estudar as possibilidades de estender o conceito de justiça como eqüidade para o âmbito externo denominado de Sociedade dos Povos. Elabora ideais e princípios para a política exterior de povos razoavelmente justos,instaurando um programa de direito internacional público. O presente artigo visa apresentar a importância de sua teoria (...) para uma sociedade internacional caracterizada pela pluralidade de doutrinas abrangentes e tentar responder as objeções tendo como base os próprios escritos de Rawls. John Rawls’s A Theory of Justice has reoriented western philosophic thought, starting a new period of reflection on justice. Designed so as to offer “one” theory, this work does not present a dogmatic purpose; however, it does propose principles of justice, resulting from a hypothetical original agreement, to constitute what it calls “justice as fairness”, characterized by the foundation of the rules of “fair” in the institutions. Through the “veil of ignorance” imposed to men in their “original position”, Rawls makes (...) the design of such principles the result of a rational common sense among individuals, trying to achieve a moral ideal that works as an alternative for the utilitarian doctrine and as the basis for a fair democratic society. The importance of Rawls’s complete work can be assessed by the great attention and comments it has received in the academic world, becoming responsible for the rebirth of discussions related to fundamental issues concerning ethics and political philosophy. This has not prevented criticism to the author’s thinking from arising. The paper aims demonstrate that the vehement disagreement used by Rawls’s critics when attacking the argument of original sense decreases the importance of his theory. (shrink)

Metaphors help us understand a concept by resorting to the imaginary because it is sometimes difficult to do so through the use of words alone. Thinkers have made use of metaphors to not only describe ‘falling in love’, ‘the pain of losing someone dear to us’, but also to describe particular concepts both in arts and sciences. In fact, the use of metaphors in some disciplines, particularly the sciences, is now regarded as something essential for the development of the field. (...) We note that influential philosophers of education, such as Martin Buber, Paulo Freire, Michael Apple, Gert Biesta and Ilan Gur-Ze’ev have also made use of metaphors to discuss education and specific issues in educational contexts. In this article, we do two things: we discuss the methodological importance of metaphors in helping us make better sense of concepts and particular problems; building on this methodological discussion, we critically discuss the problems posed by the current processes of ‘marketisation’ and ‘learnification’ in education. We conclude by arguing that metaphors do not provide us with ultimate answers to the problems we face; rather, they help us unveil a diversity of novel perspectives and a world of new possibilities. Resumo: O artigo objetiva refletir sobre as concepções de gênero, poder, multiplicidade e multiculturalismo, em María Lugones, analisando o modo como sua teoria se associa ao pensamento pós-colonial. Para tanto, aborda a perspectiva do pensamento pós-colonial e a noção de colonialidade do poder, considerando o sistema moderno/colonial de gênero. As teorias pós-coloniais criticam o paradigma epistemológico do Ocidente e a hierarquização baseada na distinção entre humanos e não humanos, colonizador e colonizado. Em sua análise do sistema moderno/colonial, María Lugones introduz (...) a ideia de gênero na reflexão acerca das relações de poder. A teoria de Oyèronké Oyӗwùmí é uma referência para María Lugones, que desenvolve uma concepção de intersecção de raça, classe, gênero e sexualidade, propondo um feminismo decolonial baseado na identificação de formas de resistência e coalizão para emancipação.: The article reflects on María Lugones’s concepts of gender, power, multiplicity, and multiculturalism, analyzing the way her theory is associated with postcolonial thought. In order to do so, it aproaches the perspective of postcolonial thought, and the notion of coloniality of power, considering the colonial/modern gender system. The postcolonial theories criticize the Western epistemological paradigm, and hierarchy based on the distinction between human and non-human, colonizer and colonized. When analyzing the colonial/modern system, María Lugones’s perspective introduces the concept of gender in the analyses of the power relationships. Oyèronké Oyӗwùmí’s theory of gender is a reference to María Lugones. In the analysis of the coloniality of power, Lugones develops the idea of the intersection of race, class, gender, and sexuality, proposing decolonial feminism based on the identification of forms of resistance, and coalition in social movements for emancipation.
